THE WRAP
As an Owner or Contractor, should you buy into a wrap insurance policy for your next Construction Project? Wrap-up insurance provides for coverage of the Contractor & Subcontractors under a single policy. Here are some pros and cons of a wrap insurance policy:
PROS
Wrap insurance allows for the general liability, excess liability, workers’ comp, builder’s risk, and more to be under a single policy. This benefit allows a single policy in lieu of multiple different policies, and you no longer need to coordinate with the Contractor and Subcontractors to ensure everyone has the same or better coverage. Also, wrap insurance allows the freedom to choose who holds the coverage; the Owner (under an OCIP), or the Contractor (under a CCIP) program.
CONS
Wrap insurance can also be problematic with the Insurance & Indemnification clauses of the prime contract & Subcontractor Agreements. The prime contract & Subcontract Agreements could provide for broader requirements than those provided under the Wrap policy. When choosing Wrap insurance, it is important to analyze Insurance & Indemnity requirements of the prime contract, and make certain similar provisions are included in the Subcontractor Agreements and the Wrap policy.
